why are we allowing "criminal rights"?

Surely when a person (male or female) decides to act in a certain way, then they have the knowledge that they are punishable for that action.
Why do we as a society believe that a minuscule prison sentence will act as a deterrent?
To put a cat amongst the pigeons do you not think that sharia law has a point? an eye for an eye etc.
If we were to bring back capital punishment (in a much more considered way) would that not act as more of a deterrent than the present system which at best is laughable.
When I was younger (47 now) we didn't hear so much about vicious crimes, although I'm sure they still happened,
So the media maybe should take some of the blame. But then again , why should we not be informed of the vagaries of life?
I don't know the answers. DO YOU?
