JUDGE SPARKS ROW OVER DNA DATABASE
Judge calls for all to be on national DNA database
Wednesday September 5,2007
A senior judge has sparked a heated row on the use of genetics in the fight against crime after suggesting the DNA of the entire UK population should be held on the national database.
Lord Justice Sedley said the current system, where DNA profiles are only taken from criminal suspects and crime scenes, was "indefensible".
His comments prompted outrage from civil liberties groups who claimed such an idea was a "chilling proposal".
The Prime Minister's spokesman was also forced to deny there were any plans to bring in a universal database.
Sir Stephen Sedley, one of England's most experienced Appeal Court judges, told BBC News: "Where we are at the moment is indefensible.
"We have a situation where if you happen to have been in the hands of the police, then your DNA is on permanent record. If you haven't, it isn't... that's broadly the picture."
He said disproportionate numbers of ethnic minorities get on to the database where there is ethnic profiling going on.
The judge suggested everybody's DNA should be on file "for the absolutely rigorously restricted purpose of crime detection and prevention".
He also proposed that DNA data from visitors to the UK should be stored.
Home Office Minister Tony McNulty said the Government was "broadly sympathetic" to what the judge had said. But he told BBC Radio 4 Today programme: "There is no Government plan to go to a compulsory database now or in the foreseeable future."

Just because some lab technician made a mistake: had an off-day, was incompetent or just plain lazy is no reason to condemn DNA testing.
But for Police incompetence, this case would not have gone as far as DNA testing and Mr Easton would have been spared his ordeal in the first place.
Interesting that you should mention fingerprinting; you will remember the recent fingerprinting debacle in Scotland. Using your logic we should stop using fingerprinting in criminal investigations.
In many cases it is not the procedure that is the problem it is the people responsible for carrying out the procedures that are the problem.

Invalid Raymond Easton has been offered £2,000 compensation by police after he was arrested for a burglary he did not commit.
Parkinson's disease sufferer Mr Easton was arrested on the basis of DNA evidence which later proved false.
Mr Easton, 49, of Pound Lane, Pinehurst, was arrested last year by Swindon Police for a burglary which he was supposed to have committed 200 miles away in Bolton.
Despite not being able to dress or bath himself and being unable to walk more than 10 yards unassisted, Mr Easton was arrested in April and charged with a burglary during which electrical equipment worth £440 was taken.
Police matched the DNA found at the crime scene to Mr Easton's, which was on file from a domestic incident four years ago that resulted in a caution.
He was told the chances of it being wrong were one in 37 million.
Despite this evidence against him, Mr Easton was adamant that on the day the burglary was committed he was at home, looking after his unwell 16-year-old daughter Xaena.
After being arrested by Swindon police on behalf of Greater Manchester police he was kept in a cell from 9am to 4pm.
Mr Easton's solicitor demanded another DNA test, which was more accurate than the first and led to the case being dropped.

As I said be afraid be very afraid
P.S Free I.D cards with fingerprint, Iris and dna data however would be a failsafe solution to prove who we actually are and I wouldn't have a problem with that

Given the government penchant for selling anything that isn't nailed down -- what are you all gonna do when you are suddenly refused insurance or MEDICAL insurance 'cos it turns out you have something nasty in your DNA?? Or your life expectancy isn't as long as you thought, -- AND YOU ONLY FOUND OUT THROUGH THE GOVERNMENT SELLING YOUR INFO TO THE INSURERS?? !!
Your application for a driving licence is turned down, because 6 years down the road, there is a risk of you having a heart attack?? I HAVE NOTHING TO HIDE - AND I AM AFRAID, -- VERY AFRAID !!!!
