Drivers who use mobile phones could face up to two years in prison

People who use mobile phones while driving could face up to two years in prison under new guidelines being published by prosecutors.

The measures being published by the Crown Prosecution Service (CPS) could also see motorists in England and Wales who cause death on the roads facing life imprisonment.

Detailed guidance on the harsher measures, which were announced earlier this year, telling prosecutors when to bring manslaughter charges, will be outlined in the policy document.

They mean the very worst cases of death by dangerous driving could instead be prosecuted as manslaughter, which carries a maximum life sentence.

Using a mobile phone, sat-nav or an MP3 player while at the wheel will be treated as dangerous driving instead of careless driving, with the chance of up to two years in prison.

Dangerous driving comes with a two-year maximum prison sentence, whereas careless driving can only be dealt with by a community order or a fine.

Director of Public Prosecutions Ken Macdonald QC said, when the measures were first announced in September: "We accept that in cases where there is clear evidence that danger has been caused by their (mobile phones) use - such as texting while driving - then our policy should spell out that the starting point for charging will be dangerous driving."

Current guidelines say manslaughter is "very rarely appropriate" in road death cases but the change will mean alternative charges could be brought against one motorist.

For example, someone who has killed on the roads could be charged with manslaughter as well as causing death by dangerous driving, leaving a jury open to return the lower charge if they find manslaughter has not been proved.

Last year's consultation paper said other aspects of bad driving may also need to be treated as dangerous driving and carry a jail term, including tailgating, tuning a car radio, "undertaking", running a red light and applying make-up or lighting a cigarette on the move.

As many have already mentioned, murderers, paedophiles and other hardcore bottomfeeders get a slap on the wrist for their heinous crimes. As well, woeful Labour is forever moaning it has not enough prisons to house the aforementioned a-holes… but for some dullard using his/her cellphone whilst driving… a place in a gulag will be readily available. Frankly a fine would suffice… madly, it does for the mindless thugs whose thrill is pounding the p**s out of some poor pensioner or other law-abiding citizen.
Meanwhile, sycophantic Brown and his spineless confederates continue their mindless and self-righteous march towards totalitarianism.

The police seem unable to solve serious crime, so to make their crime rate clear up rates look good, they have to go for the easy target, and as always, it's the motorist. For some reason, most motorists must feel that they single handedly fund everything. Really bad lot these motorists, worse than murderers and rapists. At least we aren't as lowlife as the clown running this country.

great kick an old lady to death because they ask you to stop damaging thier property and get a slap on the wrist and a brand new xbox for your hurt feelings,but get caught with a mobile and get sent to prison for two years!

There are lots of them around. And does it mean more murderers will be released in order to fit the mobile users in?

PHONES ETC

We have recently had all the estate I live on made into a 20 mile an hour zone athe cost of ??? for all the road signs, road markings, publicity in the local paper all at the expence of the council tax.tax payer. No one pays any attention to this as they are too occupied on thier mobile phones.
I and others have not seen anyone who are supposed to enforce these laws on the streets.
So what is the use of making laws if they are not enforced?
I rest my case

Mobile phone users and smokers. Stick them in jail. Now lets ban radio tuners. People with babies in the car? Passengers? All distractions....hangings too good for them! Ban satnavs, ban pedestrians. All distractions. Ban advertising signs and shop windows. Oh ban the sodding lot. Ban cars. Ban buses. How can a driver drive with 50 people on a bus? Anything else?
