DONALD Trump faces being hauled into court after a legal investigation was launched into his coat of arms.


The American billionaire has been given an official warning over the crest he has been using to promote his controversial £1billion golf course resort.


Officials claim he has fallen foul of an ancient Scots law by not registering the crest, which he has stamped on letterheads, jackets and hats.


And the Court of the Lord Lyon, which enforces the historic legislation, has now asked the procurator fiscal if there are grounds for prosecution.


It is the latest snag to hit the development, in Balmedie, Aberdeenshire, which is already at the centre of a Scottish Government investigation.


Lyon Clerk Elizabeth Roads revealed: “I understand the procurator fiscal to the Lyon Court is at present looking into the use of what may be heraldic designs by the Trump organisation.

“I am afraid I cannot say what his decision will be, but, at present, no formal action has been taken regarding the design.”


The office of the Lord Lyon was created by Robert the Bruce in 1318. The role’s main power dates back to 1592.


The then Scottish Parliament passed a law, which still stands, which makes it an offence for anyone to use a coat of arms without registering it with the Lord Lyon.


The court has its own procurator fiscal, so can bring charges independently.


In the past, Harrods boss Mohamed Al Fayed has faced charges and was forced to take down coats of arms found at Balnagown Castle in the Highlands.


It costs £900 to to register a shield with the court and more than £1,300 for the addition of a crest.


It is understood Trump has been using his crest, which features the lion rampant and a shield, all over the world to promote his other golf courses and university.


But, by continuing to use it in Scotland and not registering it, he has fallen foul of the ancient law.


He has proudly posed for photos on the sand dunes in Balmedie wearing a beanie hat featuring the crest.


It also appeared on all promotional material relating to the proposed golf course, as well as the official signs at the site and on the promotional website.


But, after being warned by the Court of the Lord Lyon, all traces of the crests have now been removed.


A spokeswoman for Trump said the billionaire was now working with the court to register the coat of arms.


Trump’s plans for his golf course, which will come with a hotel and 1,500 homes, were rejected by Aberdeenshire Council.


The application was then called in by Scottish Ministers, but a row erupted after it emerged that First Minister Alex Salmond had met Trump’s team days before it was called in.


An official investigation has been launched into how the application has been handled.
