IMMIGRATION RULES DECLARED UNLAWFUL

The Government has suffered a blow after new, tougher immigration rules for skilled workers who want to remain in the UK were declared unfair and unlawful by the High Court.

The decision torpedoes controversial changes made retrospectively to test criteria for the Government's Highly Skilled Migrants Programme (HSMP).

The Home Office said analysis showed that the previous test was "not sufficiently rigorous to select those migrants who were making the greatest economic contribution to the UK".

Some already on the programme "were simply not doing highly skilled work".

But the changes were attacked in the High Court by campaign group HSMP Forum as unlawful and a breach of migrants' legitimate expectations.

They won an important legal victory when High Court judge Sir George Newman allowed their challenge and granted them judicial review.

Critics claimed that up to 90% of the 49,000 migrants who came to work in the UK under the scheme faced being forced to leave because they would have to reapply under the stricter new points-based system.

They argued many would no longer qualify for permanent residency and faced the prospect of deportation with their families, despite having made their main home in Britain.

The Government strongly disputed the allegation and contended the numbers affected were "very small".

The judge said individuals had made statements about the hardships they would face and asked "if the new changes are likely to affect so few a number of people, what interest is there to be served by subjecting a limited number of people to considerable hardship which they would not otherwise have faced?" He said the changes were "unfair" to those already admitted to the UK under the programme.

WHO WILL PAY FOR THIS JUDICIAL REVIEW

I am no fan of Labour but give them their due on this one they are trying.
They have tried to make a law which will stop some immigrants from staying in the country and a Judge has given leave for a judicial review of this decision, this law.

Hopefully Labour will find a way to stop the appeal during the process of judicial review but who will pay for this it will cost.

The real problem here is the laws originating in Brussels which cover human rights and immigration so if you really want the problem to go away leave the EU and then we will not have to abide by all these silly laws made by people that we do not vote for and who cost us so much money.

This Country doesnt have a Govennment, we have a third rate Comedy Troupe acting as a poor excuse of a Government.

You could laugh if it wasnt so serious and the worst part is that more damaging decisions will be taken before we get the opportunity to Vote them into Oblivion !

just instruct the Government to lay out the red carpet and have the champagne on ice for all of the immigrants arriving here....??

Oops, sorry, the red carpet is already in position, and the immigrants can bring their own champers en route from France.....

What a bloody diabolical liberty. This judge should put these immigrants up in his house, or in his street to see how the other half live.

He would soon reverse his decision. Where do we get these clowns from?

It should be obvious to anyone (or at least anyone with any sense, which probably rules out Gormless Brown) that if you let people into Britain then they will probably want to stay here, and may well challenge any attempt to deport them.

HERE WE GO AGAIN

If this treacherous High Court Judge had watched Channel 4’s excellent “Dispatches” documentary on Immigration last night he would have seen that a great many British people are becoming more and more concerned about what is happening to our country and he would be ashamed of himself.

This Judge’s soft decision is no surprise though. It just provides further proof that there is a hydra operating amongst us. The whole of the “establishment” is like a many-headed serpent. It operates like a fifth column in our midst. Its sole mission is to undermine the indigenous British people at every stage of the game and to allow immigrants to win the game every time.

The “establishment” is using the classic “good guy, bad guy” routine to fool us into thinking that someone might actually do something positive to allay our serious concerns. Every time we think we have found a “good guy” to champion our cause, the serpent grows another head and yet another anti-British “bad guy” pops up to obstruct the path of the indigenous British people.

Until this week, I might have thought that the Conservatives were “good guys” and would do something positive to help us. Now I am even having second thoughts about them. Yet another “hydra” head in the form of Boris Johnson has popped up supporting an amnesty for illegal immigrants. Who would have thought that even Boris was on the other side?

It is because of this continual letting down by every section of the “establishment” that British people of all classes believe they can never win the game. That is why they are now talking openly about the dangers of limitless immigration, and, guess what, they are not happy.

If the British people cannot trust the “establishment” serpent, they must find someone that they CAN trust. It is time the British people won a game.
