WATCH OUT: Householders can be fined for flouting controversial wheelie bin rules

FAMILIES who fall foul of refuse collection laws face having to reveal medical conditions to the council.
Householders can be fined for flouting controversial wheelie bin rules, but proving who is responsible for “illegal” rubbish has turned out to be a legal minefield.
And those breaking refuse collection regulations in Plymouth are likely to be told they must nominate a “bin manager” to monitor their rubbish.
The city council is considering also issuing those homeowners with a questionnaire on their families and habits.
It would ask for the number of adults and children in the property, details of medical conditions and whether they use disposable nappies.
The “zero tolerance” move comes as councils try to make it easier to prosecute people who flout the regulations. Crimes include leaving wheelie bins on the pavement, putting the wrong items in a recycling container, and over-filling the bin.
Conservative-run Plymouth is also seeking to increase the penalty from £50 to £110.
Families are scathing about the prospect of a crackdown on bin criminals. Father-of-four Jerry Edmonds fears it will be the soft targets who get fined.
The 54-year-old lives in the Beacon Park neighbourhood with his wife Julie, 36, and children Lauren, 15, Liam, 12, Lewis, 10, and Luke, nine.
The former binman and union official said: “It is all very well the council saying that they aren’t planning to ask personal health questions – but if someone is ill, then they will expect to be told what it is.”
He added: “The city has a lot of students and Polish workers who live in multi-occupied properties. I’m worried that rather than chase after persistent offenders, they will soon move on to easy targets, like families.
“If my daughter, say, put a tin can in the bin, what am I meant to do? Do I have to root through the rubbish to make sure there’s nothing out of place?”
Sally Richards, from St Budeaux, said: “You can’t always recycle everything. My nine-year- old and 11-year-old love to recycle but sometimes the odd crisp packet and ice pole wrapper falls through the net and ends up in the wrong rubbish.
“If I am going to have to pay a fine for that, what on earth are we coming to.”
Labour councillor Chris Pattison said: “It sounds a bit draconian and intrusive to me.
“What right has someone got to ask whether you have any children or how you look after them?”
The move in Plymouth follows Exeter city council’s failed attempt to prosecute a woman for putting the wrong items in her recycling bin. Exeter spent around £6,000 bringing the case to court, but could not prove beyond reasonable doubt that the woman was personally responsible.
Lawyers doubted whether Plymouth’s proposed “bin manager” nomination would succeed.
Cathryn Smith, a partner at Foot Anstey solicitors, said it would not constitute a contract but could be used as evidence that someone had accepted responsibility. “If you don’t sign it, the council would still have to prove who is responsible.”
Plymouth’s environment chiefs said: “This will send a clear message of zero tolerance.”
A city council spokeswoman added: “The letter, which has not yet been approved, may also include a questionnaire, which would have more detailed questions such as how many people are in a household and whether they have any medical needs that we should take into account which will enable us to help them rather than prosecute them.”

What kind of madness is this? The UK is now a police state infested by petty council dictators who have never done a real days work in their lives. One day soon there will be a violent backlash against these little tyrants. Before they think up any more madcap schemes they should reflect on the fate of past dictators like Hitler and Mussolini. Will someone pass me the rope? I know a good tree.

The other day a young lad accidentally let a helium filled balloon escape into the atmosphere. The Council Gestapo jobsworth thrust a Fixed Penalty Notice into the boys' hand for £50.00.
If your wheelie-bin lid is ajar just 4" - another Fixed Penalty Notice.
If you drop a sweet wrapper - another Fixed Penalty Notice.
Yesterday, when the truckers assembled in Wales, they were immediately given a Public Order Notice by the Police.
They can find God-knows-how-many RIOT POLICE to attend the truckers' dispute - when I have NOT SEEN a police officer at pavement level for the PAST THREE YEARS.
I look forward to my local Council Gestapo jobsworth demanding my confidential medical details.
