KNIFE thugs who walk free from youth court are given back their weapons when they leave, due to a terrifying legal loophole.

Court staff, victims and witnesses arriving to give evidence are left vulnerable to intimidation or violence from gangs of armed youths.


Yobs carrying pocket knives when they arrive at court must hand them in to security staff – but they get them back because folding blades cannot be confiscated. 


Police have no power to act unless the cutting edge of a knife is more than three inches long, according to Section 139 of the Criminal Justice Act 1988.

And officers assigned to youth courts cannot confiscate larger weapons either – they only have jurisdiction inside the precinct of the court, so all they can do is report them to local police.


Robin Callender Smith, a former Youth Justices’ Clerk at Thames Youth Court in Bow, east 

London, said: “This is a long-standing problem which successive Govern-ments have never cracked.

“He was flabbergasted to see knives that had been taken from youths being handed back to them because the security guards couldn’t confiscate them. Later there was a Private Members Bill sponsored by Lady Olga Maitland MP, but it never got to grips with this problem.” 


A £3million “blood and guts” campaign launched by the Home Office last week to stem the teenage stabbing epidemic helped highlight the failing.


One image showed a bloody Swiss Army knife and screwdriver deeply embedded in a man’s torso.


The graphic scene is being used in a scheme warning teenagers about the harsh reality of knife crime via mobile phone messages and viral videos on the internet. But it served to underline the danger of the smaller folding blades youths are free to carry.


One long-serving police liaison officer, who did not wish to be named, said: “When the Home Office unveiled those pictures I was astounded to see they showed a Swiss Army knife when everyone on the force knows there is nothing that can be done to stop youths carrying them. 


Unless a suspect is caught with the blade fixed they are allowed to walk away with the knife from a youth court.


“I am aware of incidents where larger and more offensive weapons have been handed back to stop a backlash from a youth.”

Last night Shadow Home Secretary David Davis slammed the Government’s worrying ignorance over the matter. He said: “It is bad enough that so many young people are carrying knives with impunity in the street, let alone when they appear in a court. 


“Only a zero-tolerance approach – including action to confiscate such weapons and punish those carrying them – will send a clear message that we are serious about tackling the problem.”


MITIE Security, contracted to secure all courts in Britain, has been told to lock away knives found during entrance searches, give the defendant a receipt and then hand the weapon back after the youth’s case has been heard.


Without any legal backing to confiscate the knife it is left to the guard’s discretion and regard for their own safety to report larger blades to the police. 


MITIE is understood to be calling an emergency meeting tomorrow to change its agreement with the Courts Service and stop any knife entering the building.


Dee Edwards of Mothers Against Murder and Aggression said: “All knives should be banned. These youths are not wood turners association boys.”


The Ministry of Justice was last night forced to mount an inquiry that is likely to lead to a change in the law recognising smaller blades as offensive weapons. A spokesman said: “Ministers are aware of the issue and have asked officials to look into the matter.


“Her Majesty’s Courts Service  take the issue of security within courts extremely seriously and have a rigorous system in place, including mandatory bag searches, bag scanners, metal detectors and surveillance cameras.”

If you have a moron who turns up at a court with a knife and it is confiscated, then they should be destroyed. And not returned to the idiot who was carrying it.

There should be no such thing as a loophole and any such clause should be scrapped with special powers that need to be brought in.

There is no need for anyone to carry a knife of any size or description on the streets.

Knives are tools, plain and simple, and this imbecilic vendetta that puts knives to blame for knife crime is ludicrous. I use and need a knife daily in my work. Simple solutions for complex problems just don't exist and people need to engage their brain before writing irresponsible articles like this

In my opinion,"egore" has got things entirely arse about face, and should get brain out of first gear before trying to hare donwn the motorway. Under Thatcher we had nothing like the wave of ugly crime we have now. Nothing like this has been seen in this country before. People who say labour and the Tories are the same are desperately in need of white sticks and twenty years with a good psychiatrist. To return knives to the creepy degenerates who carried them , is so typical of the "politically correct" idiot minds of labour, I fail to see how even dozy labour voters cannot put two and two together without getting three and a half. I'' ll tell you what, old son, if we don't grow up soon - and I personally think that the great bulk of English people are getting as smart as a dockleaf, we will be finished for good. Get the brains in power and just see the results. You will be so surprised.

Those old enough to remember the Thatcher years will also know she came to power on LAW and ORDER. Margaret Thatcher was the first to say WE WILL GET TOUGH ON LAW AND ORDER. It never happened then and its still not happening now, in fact its got a 100 times worse. THE ROOT CAUSE IS EUROPE. 75% OF BRITISH LAW IS DECIDED BY EUROPE (Brussells) Our MPs etc are Europes Puppets. Europe put pressure on Margaret Thatcher to in turn put pressure on the Isle Of Man to abolish Corporal Punishment (the birch), the Isle Of Man now has a crime rate as bad as everywere else, full prisons etc. Even the people of the Isle say they would like to see it reintroduced. Corporal Punishment taken out of schools (the cane), now we have thugs, another gift from Europe. I sometimes wonder if those who LOST THE WAR (and now tell us what to do) are working on a different way to see us destroyed, if so its working. Dont be fooled by thinking a General Election will solve anything anything, it wont. The Tory party and Labour party are as BAD as each other (all Europes puppets).When it comes to Law and Order Gordon Brown and David Cameron will be found hideing under the same table. Its time we all looked towards another party who has the interest of Breat Britain at heart and stop swapping from one bunch of clowns to another who continualy blame each other and achieve nothing.
