LABEOUF'S LAWYER CALLS FOR POLICE PROCEDURE FOOTAGE

Saturday September 27,2008

LATEST: Movie star SHIA LaBEOUF's attorney is challenging the events that took place immediately after the actor's near-fatal car crash in July (08), stating his client may not have been "legally arrested".

Police on the scene suspected the Terminator star had been drinking prior to the crash, which left LaBeouf needing hand surgery - and he was arrested. Charges have since been dismissed due to a lack of evidence.

And now LaBeouf's lawyer, Michael Norris, is challenging police procedure on the night of the crash after the authorities suspended his driving license.

Under California law, anyone in an accident who refuses to submit to a blood alcohol test upon request has their license suspended.

Norris tells TMZ.com he can convince the officials that are keeping his client's license that LaBeouf was in no position to give blood after the crash.

Norris says, "Asking someone to provide a blood or breath test while they're being prepared for surgery on a gurney is a very unusual situation."

Norris claims LaBeouf wasn't asked to submit to the blood test until hours after he had been admitted to the hospital.

The lawyer is now asking cops to hand over video footage they have of the crash and his client's arrest, so he can determine if the actor was "legally arrested".
